Terms & Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern your use of our website and the business-to-business (“B2B”) purchase of machinery and related services from Plastmach Machine SRL.
By submitting an order inquiry or entering a purchase agreement, you agree to these Terms.

Important: These Terms apply to business customers only (B2B). Consumer rights under EU or national law for individual consumers do not apply.

2. Definitions

“Customer” – the business entity purchasing machinery or services from Plastmach Machine SRL.

“Order” – the Customer’s purchase request confirmed in writing by Plastmach Machine SRL.

“Products” – machinery, components, accessories, and services provided by Plastmach Machine SRL.

3. Ordering & Payments

Quotes are valid for the period stated in the quotation.

Orders are subject to written confirmation and agreed specifications.

Payment terms (e.g., deposit, milestones, final payment) are defined in the order confirmation.

Prices exclude taxes, duties, shipping, and installation unless explicitly stated.

Title to Products passes upon full payment. Risk transfers as outlined under Delivery & Shipping.

4. Delivery & Shipping (Europe-wide)

Delivery terms (Incoterms) and timelines are agreed in the order confirmation.

Customs and import procedures are the Customer’s responsibility unless agreed otherwise.

Risk of loss passes according to the agreed Incoterms (e.g., EXW, FCA, DAP).

Delivery dates are estimates; delays caused by logistics, customs, or force majeure are not a breach of contract.

The Customer must inspect shipments upon receipt and notify Plastmach Machine SRL promptly of any issues.

5. Warranty & Returns

Products are covered by the warranty stated in the order (e.g., 12–24 months) against manufacturing defects under normal industrial use.

Warranty excludes wear-and-tear, improper installation, misuse, unauthorized modifications, or use of non-approved parts/consumables.

The sole remedy is repair, replacement, or parts supply at our discretion. Downtime, production loss, or consequential damages are excluded.

Returns require prior written authorization. Custom-built machinery may be non-returnable except as required by law or explicitly agreed.

Customers must retain serial numbers, maintenance logs, and installation records to validate warranty claims.

6. Limitation of Liability

To the maximum extent permitted by law, Plastmach Machine SRL shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, production, or goodwill.
Our total liability is limited to amounts paid for the specific order giving rise to the claim.

7. Governing Law & Jurisdiction

These Terms are governed by the laws specified in the order agreement.
Exclusive jurisdiction lies with the competent courts of the agreed venue, without regard to conflict of law principles.
